These terms govern your use of UpScan. By creating an account or using the API, you agree to them.

1. The service

UpScan scans files you submit and returns a verdict indicating whether known threats were detected. Scanning is performed on our servers in the United Kingdom.

What scanning can and cannot do. No scanner detects all malware. UpScan uses signature matching, pattern rules, policy checks and threat-intelligence lookups, which together catch known and many novel threats — but a "clean" verdict means nothing was detected, not that the file is guaranteed safe. UpScan should be one layer of your security, not your only one.

2. Your account

You are responsible for keeping your API keys secret and for activity carried out with them. Tell us promptly at [CONTACT EMAIL] if a key is exposed, and we will help you rotate it. One account per organisation; do not resell access without a written agreement (our Agency plan exists for this).

4. Plans, allowances and payment

Plans include a monthly scan allowance, shown on our pricing page and in your dashboard. Subscriptions are billed monthly in advance and renew automatically until cancelled.

5. Availability

We aim for high availability and publish live status at /status.html, including a 90-day history. Free plans are provided without any availability commitment. Paid plans do not currently carry a contractual SLA with service credits; if you need one, contact us and we will discuss it rather than pretend otherwise.

We may perform maintenance, and will give notice for anything planned that causes downtime.

6. Your files and your data

You keep all rights in the files you submit. We claim no ownership and do not use your files to train anything. What we do with them is set out in our Privacy Policy, which forms part of these terms.

Where you use UpScan to scan files belonging to your own users, you are the controller and we are your processor, acting only on your instructions.

7. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that: UpScan is provided without warranty that it will detect every threat. We are not liable for indirect or consequential loss, loss of profit, or loss of data. Our total liability in any 12-month period is limited to the amount you paid us in that period.

This limit reflects the price of the service. If your use case needs a higher cap, talk to us about a bespoke agreement — do not simply rely on this one.

8. Suspension and termination

You may close your account at any time. We may suspend or close an account for breach of these terms, non-payment, or where continuing would put our service or other customers at risk. Except in urgent cases we will give notice and a chance to put things right.

If we discontinue the service entirely, we will give at least 60 days' notice and refund any unused prepaid period.

9. Changes to these terms

We may update these terms; the date above shows when. For material changes we will email account holders at least 30 days ahead. Continuing to use UpScan after that means you accept the new terms.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
